TERMS AND CONDITIONS

Please read the following terms and conditions of sale carefully before ordering products from us. By purchasing products from us, you agree to these terms of sale. These terms do not replace our standards of service at (Customer Service, Security, Privacy Policy and Refunds).

In these terms, "you" and "your" refer to the customer and "we", "us" and "our" refer to Game Connection (UK) Limited.

A contract for the sale of product(s) you order from us is only created once we have e-mailed you confirmation of your order. Orders are subject to availability. Where you order multiple products and not all are in stock, we may send you the products which are available, and will send the remainder of your order as soon as stock comes in. We will not be legally bound by any factual or typographical errors on the website or other promotional material.

The price you will pay for the goods is the price in the e-mail confirmation. We provide FREE 1st Class Delivery on all software and peripherals. Your order should arrive within 2 working days of dispatch. We provide a FREE next day courier service via Parcelforce for all consoles and some higher value/ large products. We also offer Special Delivery via Royal Mail for an additional charge which can be selected during the checkout process.

Once the goods have been delivered to you, you will hold them at your own risk and will be liable for their loss or destruction. We will not be liable for the loss or destruction of the goods once they have been delivered to you.

Any product with a BBFC (British Board of film Classification) rating will be clearly described as such on the product page for that item.

Warning: It is an offence to attempt to buy a certificated title if you are under age or to attempt to purchase one on behalf of someone else who is under age.

So far as the law permits, we disclaim all representations, terms, conditions and warranties (including those relating to satisfactory quality, merchantability, fitness for a particular purpose, title, non-infringement and freedom from computer viruses) relating to products provided to you by us.

So far as the law permits, we will not have any liability to you (whether or not caused by negligence) relating to products provided to you by us for any indirect, special, incidental or consequential damages. This includes loss of data, loss of income or profit, loss of goodwill, damage to reputation, damage to computer software and other computer or storage systems.

We will have no liability to you if you sell on any products provided to you by us, including without limitation, any liability to third parties for defective products.

None of the exclusions and limitations in section 3 will apply to death or personal injury caused by our negligence or to any fraudulent statement made by any of our employees.

We will not be held responsible for any failure to deliver goods ordered by you or any delay in delivering goods ordered by you or any damage to goods ordered by you, the cause of which is any event or circumstance beyond our reasonable control.

In the event that any clause in this contract is deemed to be unenforceable, the enforceability of any other part of these conditions will not be affected.

This Agreement supersedes all prior agreements, arrangements, warranties and understandings between the parties and constitutes the entire Agreement between them relating to its subject matter.

These terms and conditions cannot be varied except in writing signed by an authorised person at Game Connection (UK) Limited.

Nothing said or any representation made by any employee, including but not limited to our telesales staff, should be understood as a variation of these terms and conditions of the sale or as an authorised representation about the goods provided. Our disclaimer of liability shall include but not be limited to misleading and untrue representations but shall not include fraudulent misrepresentations.

This Agreement will be governed by and construed in accordance with English law and you will submit to the non-exclusive jurisdiction of the courts of England.

Your Loyalty Scheme discount is linked to your account and should not be given to anyone else. Discount is valid against software only. Console hardware, Accessories, Points products etc are not included. The discount does not apply to existing pre-orders. Your existing pre-orders are in a queue, and cancellations and replacements will move the order down the queue, so do so at your own risk!

Game Connection reserves the right to amend these terms and conditions, or suspend or terminate the Game Connection Loyalty Scheme at any time. If the Loyalty Scheme is terminated (for whatever reason) discounts will then be stopped and will not apply from that time. Game Connection will give the Loyalty Scheme Members as much notice as it reasonably can. Utilising the Loyalty Scheme Discount will constitute acceptance of any amended Terms and Conditions.

Individual Loyalty Scheme Accounts may be terminated at any time, at the discretion of Game Connection, where the Loyalty Scheme member breaches these Terms and Conditions or Game Connection reasonably believes that the Scheme has been abused. Game Connection reserves the right to take any appropriate action deemed necessary where a Loyalty Scheme Member is found to have abused the programme. A Loyalty Scheme Member may terminate their account at any time.

Please note that we offer sale items on a first come first served basis. Sale items are only available for a limited time only and while stocks last. Should an item become out of stock you will be emailed regarding the situation.
